1. General Conditions of Sale for purchases made online on the website www.otisopse.com


1.1 Otisopse is considered, to date, one of the most productive and appreciated footwear companies on the national scene. This is due in particular to the quality of its products and the competitiveness of the price.Otisopse also offers its customers the experience of online shopping through its website, with the aim of providing a vast assortment of models and with the advantages of a safe and simple online purchase.

Otisopse Web S.r.l. Via Guglielmo Melisurgo, 15 - 80133 - Naples, VAT: 08490801217 ("Otisopse") invites users to read these General Conditions of Sale (hereinafter "GCS") which regulate the purchase of products and the management of any orders placed on the site www.quellilainitaly.com (the "Site").

1.2 Only Otisopse branded products are offered for sale on the Site, which users interested in purchasing (hereinafter "Customer / Customers") can purchase following the purchase and sale procedures illustrated below and implemented on the Site.


2. Conclusion of the contract and delivery of the products


2.1 To proceed with the purchase of products on the Site, it is necessary to register the Customer with the same, after having read the privacy information and accepting the GCS of the same.

2.2 Each order placed on the Site implies the conclusion of a sales contract concluded between the Customer and Otisopse

2.3 By clicking on the "Buy" or "Place Order" button, the Customer places a binding order on the items contained in the virtual shopping cart. If the existing funds on the indicated account were sufficient for the purchase and the bank details provided were valid, the Bank will immediately send confirmation of the debit of the transaction to Otisopse.

Customers are shown and sent contextually, via e-mail, an order code and a payment transaction code with all the details of the purchase.

The sales contract is concluded between Otisopse and the customer only when the latter has received confirmation of the order by e-mail.

If the Customer does not receive any confirmation of the order within the term of the next 24 hours, the relative order must be considered refused by Otisopse and, therefore, without effects. In this case, for any doubt relating to the order, please contact customer service at the email address referred to in article 10.1, which follows.

2.4 Orders will be shipped as soon as Otisopse receives full payment of the purchase price and any shipping costs, where specified.

2.5 Where the product (s) inserted is not available, the Customer cannot start the purchase procedure.

However, in the event that, despite the unavailability of the product in stock, the system erroneously indicated the possibility of purchasing the goods, and the order was completed by the Customer, Otisopse does not assume the burden of procuring the product requested. The Customer will be contacted by Otisopse Customer Care, who will inform him of the problem that has occurred.

Otisopse will refund the amount paid within 7 days.

2.6 Otisopse makes deliveries on the Italian territory, the European Union and outside it. Delivery times are expressed in working days, meaning as all those between Monday and Friday, inclusive, excluding any holidays.


3. Prices, shipping costs and delivery times


3.1 The price of the goods is expressed only in Euros.

3.2 The Customer is required to pay the price published on the check-out page at the time the order is sent. The indicated price is final and inclusive of VAT and any shipping costs. Orders will be processed and / or shipped by Otisopse on Monday to Friday, from 9:00 to 17:30. Orders placed over the weekend will be processed from the first following working day.

3.3 In particular:

• Deliveries in Italy are free and shipping times vary from 3 to 5 working days;

• Shipments outside Italy, but within the European Union, have an additional cost of 15 Euros and delivery times vary from 5 to 7 working days.

• The cost of shipping and delivery times outside Italy, and from the territory of the European Union, vary in relation to the country of destination, which will still be indicated on the relevant check-out page before payment.

3.4 Please note that the delivery and / or shipping times of the goods may undergo variations not attributable to Otisopse or due to events of force majeure, such as, by way of example but not limited to, strikes, natural disasters, situations outside the company etc. etc.

3.5 During the period of sales, promotions, events or holidays, shipments may be delayed or require longer times completely independent of the will of Otisopse.



4. Payment


4.1 Otisopse accepts payments made by credit card from the Maestro circuit, Mastercard, Visa, PayPal, Diners and PostePay.

4.2 Once confirmation has been obtained from the banking institution of the payment, Otisopse proceeds to forward the Customer an e-mail containing the confirmation of the payment and an identification number of his order. Once the shipment of the goods has been completed, Otisopse will proceed to send the Customer an additional e-mail with the data necessary for the traceability of the package.

4.3 If the existing funds on the indicated account were sufficient for the purchase and the bank details provided are valid, the bank will instantly send confirmation of the debit of the transaction. Customers are shown and sent contextually, via e-mail, an order code and the payment transaction code. The entire amount will be charged to the credit card at the time of purchase. (Orders are processed from Monday to Friday, with the following hours: 9.00-17.30. Orders placed over the weekend will be processed from the first following working day)

4.4 In order to ensure greater protection on purchases made in the e-commerce sector, Otisopse recommends its customers to join the Verified By Visa or Mastercard Securecode services, requesting a PIN security code with which to make their purchases. In any case, the Site uses the https / ssl protocol to guarantee the security of the information exchanged through it.

4.5 If the indicated account does not have the necessary funds to proceed with the purchase and the payment request is therefore rejected, the contract is to all intents and purposes not concluded.


5. Application of promotional vouchers

Promotional vouchers:

• they can have a value expressed in% or a fixed amount;

• cannot be purchased by customers but are offered by Otisopse as part of promotional campaigns;

• can be used for a limited period of validity.

Some promotional vouchers can be applied to the entire amount of the goods in the virtual shopping cart, others, on the other hand, will only be applicable to the individual product. Promotional vouchers can be used:

• only once in relation to a single order;

• within the specified validity period.

Furthermore, it is possible that the possibility of using promotional vouchers or the use of a promotional voucher is subject to a minimum amount of expenditure for the purchase of some products.

If the amount of the promotional voucher is not sufficient to cover the value of the product / s ordered, the difference can be paid in the manner indicated in art. 4.

Promotional vouchers cannot be combined for the same order or transferred to third parties, but can only be used if the order is finalized. Furthermore, the same cannot be used retroactively.

If, during the order, the customer should have used a promotional voucher and the overall value of the order - due to the customer's withdrawal - should be less than the value of the promotional voucher, Otisopse reserves the right to invoice the original price of the goods that remain in the customer's possession.

Otisopse may condition the use of the aforementioned vouchers on reaching a minimum spending threshold, for which the shipping costs are to be considered excluded.


6. Cancellation of the order and right to rethink

The customer can choose to cancel your order at any time, before the delivery of the product. To exercise the aforementioned right, the Customer must write an email to the address specified in art. 10.1 following. Once the request is received, Otisopse will cancel the order and refund the amount paid, within 14 days from the date on which Otisopse received the customer's request.


7. Right of withdrawal

7.1 Pursuant to art. 49 and following of the Consumer Code (Legislative Decree 206/2005) the Customer has the right to withdraw from the contract without giving any reason within, and no later than, 14 days from the day on which the Customer or a third party, other than the carrier, enters in possession of the purchased good.

7.2 In order to exercise the right of withdrawal correctly, the Customer can:

a) Use the withdrawal form referred to in Annex I, part B, and send it by registered mail to / from Otisopse web srl , Via Guglielmo Melisurgo 15 80133 Napoli 

b) access your private area and click on the appropriate tab. Through it, he will access a precompiled form which he must integrate with the missing and necessary information.

Following the receipt of the withdrawal request, Otisopse will send the Customer a communication by email confirming the same.

7.3 The Customer, moreover, within 14 days of sending the withdrawal request, will be required to return the goods to Otisopse, by means of the courier who performed the delivery and at his own expense. The goods must be shipped in the following ways:

• Properly packed in their original packaging, undamaged, damaged or soiled and equipped with any accessories and documentation, and without manifest signs of use;

• Equipped with the original transport document (present in the original packaging), in order to allow Otisopse to uniquely identify the Customer (Order number, name, surname and address);

If the methods and times indicated above for the return of the goods are not respected, Otisopse reserves the right not to accept the return itself and not to make a refund.

7.4 Following the withdrawal from this contract, Otisopse will, within and no later than 14 days after receipt of the goods in question or receipt of the proof, by the Customer, of the shipment of the same, depending on which situation occurs first, to reimburse the Customer the price paid at the time of purchase, including standard shipping costs. Where the Customer, if available, has chosen a different method from the standard one, the refunded price will only cover the difference between the cost of standard shipping and that chosen by the Customer. If damage to the purchased product derives from the use of the asset by the Customer, such that its value has decreased, the Customer will respond to Otisopse.

7.5 This refund will be made using the same payment instrument used by the customer during the purchase phase. In any case, the Customer will not be required to incur any costs as a consequence of this refund, except for the shipping costs for returning the goods.

7.6 In case of withdrawal concerning all the products purchased, the initial delivery costs will also be reimbursed. Otherwise, in the event of a "partial" withdrawal (concerning only part of the products purchased), the costs of the initial delivery will not be refunded.

If the aforementioned methods for the withdrawal and return of the goods are not respected, Quellilainitaly reserves the right not to accept the withdrawal and not to reimburse, subject to compliance with the legal obligations against him.


8. Returned

8.1 Returned in case of damaged goods

a) "Damaged goods" are defined as goods which, at a brief and rapid examination, present defects that can be identified immediately.

b) The defect from which the purchased goods are affected must be reported by the Customer no later than 60 days after the date of receipt of the goods, by writing to the e-mail address info@otisopse.com or by registered mail with return receipt. to Otisopse Web Srl, Via Gugliemo Melisurgo 15 80133 Napoli(NA);

c) The customer will also be required to return the goods in the following ways:

• Properly packed in their original packaging, undamaged, damaged or soiled and equipped with any accessories and documentation, and without manifest signs of use;

• Equipped with the original transport document (present in the original packaging), in order to allow Otisopse to uniquely identify the Customer (Order number, name, surname and address);

If the methods and timing indicated above for the return of the goods are not respected, Otisopse reserves the right not to accept the return itself and not to make a refund.

d) The shipping costs of the returned goods will be borne by Otisopse, which will collect the goods by means of its own courier.

e) The Customer will be reimbursed for the price of the returned products and the cost of the initial shipment, within 14 days from the day of collection of the goods by Otisopse. The refund will be made through the same payment method chosen by the customer during the purchase. In case of payment by credit card or via Paypal circuit, the refund will be made by crediting the amount in question to the customer's account.


9. Refunds

9.1 Refunds are credited directly through the method in which the customer made the payment.


10. Customer Service

10.1 The Customer can contact Otisopse Customer Service, which will be active from Monday to Friday, from 09:00 to 17:30, at the email address info@otisopse.com

10.2 Requests received outside of the times indicated above will be processed from the first following working day.


11. Warranty for defects and product defects and additional information

11.1 The provisions of the Consumer Code apply to purchases made on the Site in terms of warranty for defects and non-conformities of the products. The Customer will therefore be recognized the rights pursuant to art. 128 and following of the Consumer Code and these rights must be exercised in the terms set out in art. 132 of the same Consumer Code.


12. Applicable law and jurisdiction

12.1 Italian law (and in particular the Consumer Code - which in articles 46 to 67 governs distance contracts) and Legislative Decree 70 of 09/04 are intended to be applied to these GCS and to the related sale and purchase agreements. / 2003 on e-commerce) in the light of which they must be interpreted.

12.2 Pursuant to article 447bis of the Code of civil procedure and art. 66-bis Consumer Code, Legislative Decree 206/2005, in the event of a dispute arisen between the parties regarding the interpretation, termination and / or application of this contract, the judge of the place of residence or domicile of the consumer has territorial jurisdiction, if located in the territory of the state. If, on the other hand, the consumer is resident or domiciled outside Italy, the Court of Naples will have exclusive jurisdiction for disputes concerning the matters cited so far.
